As required by law, you are hereby notified that a negative credit report reflecting on your credit record may be submitted to a credit reporting agency if you fail to fulfill the terms of your credit obligations. No such credit information will be provided prior to 35 days from the date you receive this letter. 

California Civil Code Section 1788.21(a) states that you are obligated to notify your creditor of any changes in your name, your address, or your employment after you receive written notice of your obligation to do so. This constitutes the required written notice.  As the agent of your creditor, please keep us informed of any changes to your name, address or employment.

The State Rosenthal Fair Debt Collection Practices Act and the Fair Debt Collection Practices Act require that, except under unusual circumstances, collectors may not contact you before 8 AM or after 9 PM. They may not harass you by using threats of violence or arrest or by using obscene language. Collectors may not use false or misleading statements or call you at work if they know or have reason to know that you may not receive personal calls at work. For the most part, collectors may not tell another person, other than your attorney or spouse, about your debt. Collectors may contact another person to confirm your location or enforce a judgment. Nonprofit credit counseling services may be available in the area. State and Federal law require debt collectors to treat you fairly, and prohibit debt collectors from using profane language or making improper communications with third parties, including your employer.

MCT Group Inc. utilizes call recording technology.  Calls may be recorded.


Privacy & Information Collected

MCT Group Inc. is a debt collector whose business does not fall under the regulations of the California Consumer Privacy Act, also known as "CCPA".  CCPA protects the rights of of California consumers and provides both transparency and controls for the consumer to understand what information is collected about them and if necessary, revoke permissions regarding the sale or dissemination of that information, where applicable.  

In order for a business to fall under CCPA regulations, it must satisfy all conditions (1-4, including one of the three subconditions):

Thus, MCT Group Inc. does not satisfy any of these subconditions.

While MCT Group Inc. does not satisfy enough conditions to fall under regulation of the California Consumer Privacy Act, in the interest of transparency, we voluntarily disclose, for the benefit of the consumer, the categories of personal information we may typically collect about them. These categories are:

(a) personal identifying information, like name, address and account number, social security and drivers’ license number, as well as other identifying information, which we permissibly obtain from the consumer’s creditor, credit reports, other skip tracing tools, and the consumer;

(b) characteristics such as age, gender, etc., which we permissibly obtain from the consumer’s creditor and consumer’s credit report;

(c) retail information, which we obtain from the consumer’s creditor and the consumer’s credit report;

(d) internet activity regarding online payments to MCT, which we collect if the consumer visits our website and its payment portal;

(e) geolocation data, which we obtain from process servers and/or if the consumer visits our website or payment portal;

(f) recordings, which are made when the consumer has a telephone conversation with us;

(g) professional and employment related information, which we permissibly obtain from the consumer, the consumer’s creditor, credit reporting agencies, and other skip tracing sources;

(h) educational information, which we obtain from the consumer, the consumer’s creditor, credit reporting agencies, and other skip tracing sources.

All of the information that is collected is used solely for the permissible purpose of debt collection and secured using a variety of data security and access controls, commonly referred to as AICPA Trust Services Criteria.  This information is not stored online, nor is it accessible online. MCT Group Inc. does not sell consumer's personal information. MCT Group Inc. is not in the business of buying or selling personal information and is a debt collector acting as an authorized agent of your original creditor.  While we are not required to comply with a CCPA request, If you wish to request the categories of information or the actual information we have collected about you, please call us at 1-800-622-2242.
